Welcome to EBENtrellis. These Terms of Service ("Terms") govern your access to and use of the EBENtrellis platform (the "Platform"), operated by EBENtrellis ("we," "us," or "our"). By creating an account or using the Platform, you agree to these Terms.
EBENtrellis is a sponsorship marketplace that connects school athletic programs ("Teams") with local businesses ("Sponsors") who wish to provide financial sponsorship in exchange for recognition and goodwill. EBENtrellis facilitates the connection, communication, and payment process between Teams and Sponsors.
EBENtrellis is not a party to any sponsorship agreement between a Team and a Sponsor. The specific terms of what a Sponsor receives in exchange for a sponsorship (such as signage, social media mentions, or other recognition) are agreed upon directly between the Team and the Sponsor. EBENtrellis does not guarantee, enforce, or take responsibility for the fulfillment of any such arrangement.
You must be at least 18 years old, or have the involvement and consent of a parent, guardian, or authorized school representative, to create an account and connect a bank account to receive funds. Team accounts should be created and managed by a coach, athletic staff member, booster club representative, or other adult authorized to act on behalf of the team.
You are responsible for the accuracy of the information in your profile and for maintaining the security of your account credentials.
Teams may be asked to submit documentation demonstrating affiliation with the school or program they represent before receiving sponsorship funds. EBENtrellis reviews this documentation on a good-faith basis but does not independently verify the authenticity of submitted documents beyond reasonable review, and does not guarantee the identity or legitimacy of any Team or Sponsor.
All payments on the Platform are processed through Stripe, a third-party payment processor. EBENtrellis does not directly store or handle payment card information or bank account credentials.
EBENtrellis retains a percentage of each sponsorship as a platform fee to support the operation of the Platform. The remainder is transferred to the account designated by the receiving Team.
Sponsors may request a refund of a sponsorship within 14 days of the original payment by providing a written reason through the Platform. Refund requests are reviewed and, if approved, reverse the full amount, including the platform fee, back to the Sponsor's original payment method. Refunds are not guaranteed for requests made after this window; Sponsors and Teams are encouraged to resolve disputes directly in such cases.
EBENtrellis does not provide tax, legal, or accounting advice. Whether a sponsorship payment is deductible as a charitable contribution or business expense depends on factors specific to the Sponsor and the recipient Team's organizational and tax-exempt status, which EBENtrellis does not verify or guarantee. Sponsors and Teams should consult a qualified tax professional regarding the tax treatment of any payment made or received through the Platform.
You agree not to use the Platform to: provide false or misleading information about your identity or affiliation; harass, abuse, or attempt to defraud another user; use the Platform's messaging system for purposes unrelated to a sponsorship relationship; or attempt to circumvent the Platform's payment system to avoid applicable fees.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraudulent or harmful activity.
The Platform is provided "as is" without warranties of any kind, express or implied. EBENtrellis does not guarantee that the Platform will be uninterrupted, secure, or error-free, or that any particular sponsorship outcome will occur.
To the fullest extent permitted by law, EBENtrellis shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, or from any dispute between a Team and a Sponsor.
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
